GENERAL RULES

Article 1. Organization

 

Each participant or visitor of Frag-o-Matic (abbreviated FOM), which is organized by VZW E-EVENTS, has to agree with these general rules and with every decision VZW E-EVENTS takes or will take about them. Such decisions of VZW E-EVENTS can not be disputed. VZW E-EVENTS reserves the right at all times to make changes to these general rules when necessary. The current, common version of the general rules will be dated and published on the website of FoM (http://www.fom.be). If something is not clear in these general rules, then you can contact VZW E-EVENTS for more information. Participants can receive a printed copy at FoM upon request.

Article 2. Registration and access

 

VZW E-EVENTS is entitled to request a fee in the form of a sum of money in exchange for participation or visiting a FoM event.
Participation or visitation of a FoM event is only possible after full payment, including any payment costs, of the entrance fee requested by VZW E-EVENTS, and after receipt by VZW E-EVENTS of an appropriate registration form, where all requested information is given truthfully.
The participant or visitor is registered for the event onceboth conditions are fulfilled before the end of the subscription period, determined by VZW E-EVENTS.
VZW E-EVENTS reserves the right to deny access to individuals.
The subscription for a FoM event can be extended or shortened by VZW E-EVENTS at any time.
The admission price for a FoM event can be changed by VZW E-EVENTS at any time or be made dependent on the period when the payment is received or the way the payment is made. These changes will be announced on the website (http://www.fom.be).
VZW E-EVENTS bears no responsibility for entries that can not be found in the database or any administrative error of any third party.

 

 

VZW E-EVENTS takes into account the legal requirements of distance selling, if applicable.
The cancellation of a registration and reimbursement of fees beyond the legal timeframe is only possible if approved by VZW E-EVENTS.
VZW E-EVENTS can provide a period where cancellation and reimbursement are possible, in which case the participant can obtain more information about this using info@fom.be or on the website of the event (http://www.fom.be) .

 

 

It is strictly forbidden to register for a FoM event under a different name or address than stated on the identity card of the person concerned or any other identity document which the person relies on.
In this case this person not only loses the right of access but also any right to compensation and the right for reimbursement of the already paid registration fees.

 

 

Visitors or participants of a FoM event who are under 18 years must always be accompanied by a parent or legal guardian. If this is not the case, they provide for themselves a prior written agreement of their parent or legal guardian, dated, signed and valid for the duration of the event.
If this condition is not met then they may not participate or visit the FoM event. This written agreement may by VZW E-EVENTS are requested throughout the duration of the event FoM.

 

 

All persons wishing to enter the FoM event are required to prove their identity before they actually will be granted access to FoM.
They also accept that the VZW E-EVENTS can keep a copy of the identity document which the person appeals on, whether in digital form, for administrative purposes.
VZW E-EVENTS has also always the right to withdraw access to a FoM event if it deems necessary, without an explanation or compensation.

 

 

A participant in a FoM event has the right to take up maximum one place assigned to him by VZW E-EVENTS with just one computer and one display and all the necessary associated peripherals for the duration of the event.
All electrical or electronic devices that do not belong to the necessary peripheral equipment such as refrigerators, microwave ovens, coffee machines, printers, scanners, strobes, megaphones, horns, generators, multiple computers and monitors etc. are only allowed if the participant has requested and received prior written approval from VZW E-EVENTS.
Only VZW E-EVENTS is authorized to judge which devices are acceptable and which not.

 

 

The use of speakers is prohibited, participants in a FoM event should provide their own headphones, or they will have no sound. Violation of this rule will require the offender to deliver his speakers to VZW E-EVENTS for storage during the entire FoM event.

 

 

It is not allowed to bring animals or weapons in the area of the FoM event.

Article 3. Competitions

 

Matches are contested by category and finished in an organized way, called competitions. While certain competitions are played with teams there can only be individual registrations for it.
Each participant can have only one identification number (abbreviated ID) and is permitted only one competition entry: two people can not participate in competitions on the same computer.
Each registration for FoM gives only one registration for the competitions. Visitors may not participate in the competitions.

 

 

In order to allow international participants to take part in the competitions, English is the main language in all forms of communication about these competitions. Dutch may also be used.
For the smooth running of these competitions there are strict competition rules, called the "competition rulebook". Each participant is supposed to have read, know and unconditionally agree to them before taking part in the competitions.
VZW E-EVENTS reserves the right at all times to make changes to the competition rules, these changes will be posted (http://www.fom.be).

 

 

VZW E-EVENTS or its appointees will monitor the regularity of the FoM event and related competitions, the application of the regulations, the designation of the winners and will award the prizes.
These decisions can not be disputed, nor can the participant claim damages for the consequences of these decisions.
If a participant is identified as a winner and receives a prize, which will be determined by VZW E-EVENTS as it deems fair, additional conditions may be required by VZW E-EVENTS to receive this award or prize: such as attending the awards ceremony, to give interviews, sign a receipt ... and so on.
The parties will respect these conditions otherwise they lose the right to a prize.

 

 

Article 4. Order, theft and damage

 

VZW E-EVENTS can not be held liable for any damages, whether direct or indirect, to any person, whether or not participants, or materials (including hardware and software) as a result of participating in a FoM event.
This also applies to technical failure and / or defects in hardware, software and vehicles and brought items by other participants whether or not caused by problems with the electricity network, the network, through fire or water damage and / or use of fire extinguishers.

 

Persons who enter the FoM event accept responsibility for cleaning up the waste produced by them and deposit it in the provided trash bags and / or bins, provided by VZW E-EVENTS.

 

 

A FoM event is held in an event hall, which is not owned by VZW E-EVENTS.
Participants and visitors accept the house rules, will respect these and behave properly throughout all the parts of the event hall terrain.
Participants or visitors who indulge in drunkenness, vandalism, riots, fights, noise at night, indecency, being under the influence or causing disorder can at any time be sanctioned by the provisions of Article 10 of these general rules and in case of criminal offence the police will be alerted .
VZW E-EVENTS can recover damages of the participant.

 

 

VZW E-EVENTS is not responsible for any accident, loss or theft. Each participant waives any claim against VZW E-EVENTS in this regard.

 

 

Everyone is obliged to free up all the aisles and exits to ensure a possible speedy evacuation at any time.
Any object or vehicle that makes a potential evacuation difficult may always be removed by VZW E-EVENTS and if there are costs involved then they have to be paid by the owner of this object or vehicle. These costs can not be recovered from the VZW E-EVENTS.

 

 

Article 5. Responsible use of the network

 

VZW E-EVENTS respects the copyright of those involved in the creation and distribution of copyrighted material like music, movies, computer programs, video games and other literary, artistic and scientific works created by third parties. The same is expected from the participants and visitors to a FoM event.

 

Participants and visitors to a FoM event may in no case make unauthorized copies of copyrighted material, the same goes for downloading, offering streaming, seeding, storage, burn optical media, distribute or sell them during the event.
Setting up servers or services to exchange copyrighted material is forbidden. Anyone that does not obey this rule, may be punished by the penalties mentioned in Article 10 and may also be subject to civil and criminal proceedings.

 

 

The computer network offered by VZW E-EVENTS may only be used for lawful purposes. The participant is solely responsible for the content of the data he consults, or exchanges over the network.
VZW E-EVENTS manages the network as a good as possible and can not be held liable for infringements committed by third parties through the network and the infrastructure of the FoM event.

 

 

The network offered by VZW E-EVENTS merely acts as a conduit of information, according to the conditions imposed in Article 18 of the Act of 11 March 2003 on certain legal aspects of the information referred to in Article 77 of the Constitution. With respect to providing this service the VZW E EVENTS, according to Article 21 of that Act, has no general obligation to monitor the information which they transmit or store, nor to actively seek facts and circumstances that indicate illegal activity.

 

 

The participant should obey to all the potential additional indications and limitations VZW E EVENTS, or its appointed third party, impose on the use of the network now or in the future.

 

 

Each participant will be assigned only one IP address by VZW E-EVENTS and can use only one network port, connected to his place on the event assigned by VZW E-EVENTS.
It is strictly forbidden to use a different IP address on the network. It is forbidden to change the hardware address (or MAC address).

 

 

A participant may only use his own computer even if he has permission from the person where he wants to use the computer from, accept computers provided by the VZW E-EVENTS for this special purpose and with concern of the restrictions required by VZW E-EVENTS.

 

 

It is forbidden for visitors and all those who are not participants to use the wired network, even through the computer of a participant.
It is forbidden for anyone to set up their own computer network in the area of a FoM event during the entire course of the event.

 

 

Only VZW E-EVENTS or its duly authorized person has the right to carry out checks on the network, such as scanning IP addresses and ports as well as monitoring and logging of network traffic.
They will apply the conclusions provided in the opinion number 44 of the Commission for the protection of privacy, of November 12, 2001, regarding the compatibility of the investigation into violations of copyright on the Internet with the legal provisions to protect personal data and telecommunications.
VZW E-EVENTS plays a role in this area similar to that of an internet service provider and its customers a role in this area similar to that of a subscriber.

 

 

To act in accordance with the law, the record companies and authorized agents of corporations for the management of copyright can only judge case by case and based on information which is publicly available online (pseudonyms, date and time that these files are distributed) to determine whether copyrights have been violated and sue on that basis, the determinations made by the copyright management companies that work with agents approved for this purpose obviously have greater probative value.
These proceedings may be set after the record company or SABAM (and not through participation of a provider) has informed the user that he is participating in an illegal activity. Except in the context of legal proceedings, an internet provider may not communicate subscriber information to third parties.
In the present state of the law, the judicial authorities are responsible to do all general investigations that could result in a list of persons who violate copyrights.

 

 

Hacking, cracking, sniffing, spamming, floaden, spoofing or abuse of the network and servers offered by VZW E-EVENTS in any way, including the provisions mentioned in this article results in the measures and sanctions provided for in Article 10.

 

 

Article 6. Commercial activity

 

Distribution of advertising on a FoM event for any purpose is prohibited, unless agreed upon in advance with a written approval of the VZW E-EVENTS.
Failure to obey this will result in compensation to the VZW E-EVENTS and its sponsors.
Engaging in commercial activities such as but not limited to buying, selling, delivering services on a FoM event without prior written permission of the VZW E-EVENTS is prohibited.
Also for these activities compensation can be demanded by VZW E-EVENTS. These provisions apply during the course of the event and in the entire area of the FoM event.

 

Article 7. Anti smoke & drug policy

 

Inside the hall of the FoM event it is forbidden to smoke. This smoking ban applies to everyone and also applies to e-cigarettes or vaping.
The use, possession and sale of any illegal drugs (such as cannabis) is always forbidden for everyone.
For serious offenses, the police will be warned.

 

Article 8. Transmitters and internal communications

 

It is forbidden for anyone in the territory of the FoM event to use broadcasting equipment that works on the PMR446 band, unless specific prior written permission of VZW E-EVENTS has been obtained.
All devices that use it without permission will be confiscated until the end of the event.
It is not allowed to listen to internal communications by VZW E-EVENTS and its employees, by any means whatsoever, before, during or after the event or to hinder them in any way.
One is obliged to conceal any information that can accidentally be heard in the communication between the VZW E-EVENTS and its employees before, during or after the event.

 

Article 9. Control

 

VZW E-EVENTS or its duly authorized person has the right to check any equipment or items that any person brings to the area of the FoM event.
This includes but is not limited to computers, data storage for all equipment including its contents, brought backpacks and bags, cooling bags and vehicles.
Every person is expected to cooperate fully with this audit.

 

Article 10. Penalties

 

VZW E-EVENTS has the right to speak out penalties for all violations as specified in these regulations. These sanctions may include, but are not limited to:

  1. An official warning with the explicit demand to terminate immediately and unconditionally any prohibited or suspicious activity.
    This warning may be kept in writing by VZW E-EVENTS, for administrative reasons, including the name of the person during the duration of the event.
  2. VZW E-EVENTS reserves the privilege to deny the person the access to the FoM event at any time in case of repeated violations, suspicious behaviour, not following the directions of VZW E-EVENTS or serious offences and the person has not the ability to charge a compensation request.
    For serious offences the police will always be warned.
  3. Offenders may be suspended for a specified period for all future activities by VZW E-EVENTS.
  4. Outside of these penalties, VZW E-EVENTS may also seek compensation from the person for the damage.
    These sanctions are not limited to the strict duration of the event and are valid for all participants and visitors, including any persons accompanying them, to the FoM event.

 

Article 11. Privacy

 

Personal data received by VZW E-EVENTS will be processed in accordance with the law of 8 December 1992 to protect the privacy and the law of 11 December 1998 transposing Directive 95/46/EC of 24 October 1995 on the protection of individuals with regard to the processing of personal data and on the free movement of such data.

 

These data can be used by VZW E-EVENTS for the following purposes: to inform about commercial activities and promotions of products, services and events.

 

 

Every person who enters a FoM event accepts that their name (including any pseudonyms) and / or photo can be published as well as their likeness or portrait reproduced and communicated to the public in any way, including through films and streaming, including but not limited to the websites of the organizers, including http://www.fom.be

 

 

VZW E-EVENTS can collect personal data for new purposes not yet described here in this privacy policy. In that case, we will contact the person concerned before personal information is used for these new purposes, to inform him of any changes to our privacy policy and the opportunity to modify or delete these data.

 

 

VZW E-EVENTS will never give or sell collected data to third parties. All personal data transferred to VZW E-EVENTS will be held with the utmost discretion. When sending personal information, keep in mind that sending such information over the Internet is never without risk.
Damages resulting from the unauthorized use of personal data may therefore under no circumstances be charged to VZW E-EVENTS.

Your personal details are then deleted from our database for free. You have a right to access and correct your personal information. Please contact us by e-mail at info@fom.be, if you wish to view certain data, delete or modify them. You can also ask to modify any data that is inaccurate, incomplete or irrelevant.

 

 

Article 12. Nullity and jurisdiction

 

The nullity of one or more points of these regulations shall not prevent that any other points remain valid.
All contracts, services and operations for a FoM event are subject to Belgian law and for all disputes which could occur, only the Courts of the district of Leuven, or the district of the FoM event have jurisdiction.
